terms of service

1. the agreement

These terms are an agreement between you and pondar LLC ("pondar", "we", "us") for using the pondar app, its App Clip, the pondar.app website and the games in them (together, "pondar"). By using pondar you agree to them. Your use of the app is also covered by Apple's Licensed Application End User License Agreement. Apple isn't a party to these terms and isn't responsible for pondar. Our privacy policy explains how we handle your information.

2. who can play

You must be at least 13 years old, or the minimum age to use online services in your country if that's higher. If you're under 18, a parent or guardian must agree to these terms for you.

3. your account

You sign in with your Apple account. Keep it secure: you're responsible for what happens in pondar under your account. Let us know if you think someone else is using it.

4. playing fair

When you use pondar, don't:

• cheat, including by modifying the app, tampering with game data or our servers, or using bugs to your advantage (please report bugs instead);
• disrupt pondar, for example by overloading or attacking our servers, accessing them with bots or scripts, or getting around our security;
• harass, threaten or impersonate other players, or use pondar for anything illegal.

We may end games or suspend accounts that break these rules.

5. purchases

Purchases in pondar, such as the full game, are sold through Apple's App Store under Apple's terms, at the prices shown there. Refunds are handled by Apple. A purchase unlocks content for use in pondar, not ownership of it, and can be restored on your devices with the same Apple account. Purchases and unlocks have no cash value and can't be transferred. Content you unlock by playing, such as characters unlocked by inviting friends, may change as the game evolves.

6. the game and its content

pondar and its games, characters, artwork, 3D models, sounds and code belong to pondar or its licensors. We give you a personal, non-commercial, non-transferable license to use them through pondar while you follow these terms. Don't copy, sell, rent or reverse engineer them, except where the law allows it.

7. feedback

If you send us ideas or feedback, we can use them to improve pondar without owing you anything.

8. changes and availability

We keep improving pondar, so games, characters, maps and features may change. pondar may sometimes be unavailable, for example during maintenance. We may stop offering a game or pondar itself; if we do, we'll try to give you notice in advance.

9. ending things

You can stop using pondar at any time and delete your account in the app (settings, then delete account). We may suspend or end your access if you break these terms, or when needed to protect pondar or its players.

10. disclaimers

pondar is provided "as is" and "as available". To the extent the law allows, we don't make promises about pondar beyond those in these terms, including that it will always be available or free of errors.

11. limits on liability

To the extent the law allows, pondar isn't liable for indirect, incidental, special or consequential damages, or for lost data or profits. Our total liability for any claim about pondar is limited to the amount you paid us in the 12 months before the claim, or $10 if you didn't pay anything. Some places don't allow these limits, so they may not apply to you. Nothing in these terms limits rights you have under consumer protection law.

12. law

These terms are governed by the laws of the State of Texas, USA, and disputes will be handled in the state or federal courts in Texas, except where the consumer protection law of the place you live gives you the right to bring a claim there.

13. changes to these terms

If we change these terms, we'll update this page and the date at the top. If the changes are significant, we'll also let you know in the app. Continuing to use pondar after changes means you accept them.
